1. Acceptance of terms

By accessing or using EmailShaper ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of service

EmailShaper is an email design and sending tool that allows you to compose HTML email templates and send them via your connected Gmail or Outlook account. We do not operate an email server — all emails are sent through your own account using credentials you provide.

3. Your account

You must sign in with a valid Google or Microsoft account. You are responsible for maintaining the security of your account and all activity that occurs under it.

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.

4. Acceptable use

You agree not to use the Service to:

  • Send spam, unsolicited bulk email, or messages that violate CAN-SPAM, GDPR, or other applicable laws
  • Harass, threaten, or impersonate any person or organisation
  • Distribute malware, phishing content, or fraudulent material
  • Violate any applicable local, national, or international law or regulation
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure

5. Intellectual property

You retain ownership of any content you create using the Service. EmailShaper retains all rights to the Service itself, including its design, software, and branding. You may not copy, modify, or distribute any part of the Service without written permission.

6. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Service is at your own risk.

7. Limitation of liability

To the maximum extent permitted by law, EmailShaper and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of data, revenue, or goodwill, even if advised of the possibility of such damages.

8. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these terms or is harmful to other users, us, or third parties. You may delete your account at any time by contacting us.

9. Changes to these terms

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms. We will update the "Last updated" date at the top of this page when changes are made.
